US Judge Orders Freedom of Abrego Garcia from ICE Detention
A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement is without legal authority.
"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been re-detained, again without lawful authority," the judge stated in her ruling.
The case originates in a mistaken removal to El Salvador in March, which US authorities later admitted was an mistake. After his repatriation to the United States to answer human smuggling charges, he was held in immigration custody.
In her order, the court noted that the authorities lacks a valid removal order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."
Background of the Case
The court proceedings center on conflicting assertions. Whereas the Trump administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he categorically denies this claim.
He has also entered a not guilty plea to the conspiracy counts, which are part of a ongoing trial in Tennessee.
Terms of Release
The judge, who was overseeing his challenge to deportation in a federal court, determined that he must now comply with the terms of his bond from custody in Tennessee. This decision shifts his supervision to the jurisdiction handling his criminal case.
This ruling represents a significant development in a complex immigration case involving allegations of mistaken imprisonment and contested criminal affiliations.
